Actress Lindsay Lohan will head to trial March 18 to face three Santa Monica misdemeanor charges after her attorney Mark Jay Heller was unable to have two of the counts relating to her June 2012 PCH car crash dismissed at a hearing Friday morning at the LAX branch courthouse.
Heller contended that the actress was not advised of her rights following the crash and was questioned at a Santa Monica Hospital after she invoked her right to have an attorney present.
According to court documents, Heller contended the counts should be dismissed “on the basis that the Santa Monica Police Department Officer was no acting or engaged in the lawful performance of his duties, and was acting unlawfully.”
The dismissal of the counts were rejected by Superior Court Judge James R. Dabney.
The Santa Monica City Attorney’s Office charged Lohan on Nov. 29 with willfully resisting, obstructing or delaying an officer, providing false information to an officer, and reckless driving relating to an accident on the Pacific Coast Highway on June 8, 2012.
Lohan claimed she was not driving a Porsche that rear-ended a truck, but a Santa Monica Police Department investigation states otherwise.
She could face jail time as the misdemeanors carry potential sentences ranging from three months to a year.
Lohan previously pleaded not guilty to the charges through her then-lawyer Shawn Holley on Jan. 15.
