LEGAL BRIEFS: Bayside Dismissal Denied

The court has once again denied a motion by defendant Bayside District Corporation to enter summary judgment in its favor in the civil lawsuits arising out of the 2003 Farmers’ Market tragedy. Bayside made the motion on the grounds that there is no disputed issue of material fact in the case and that Bayside is entitled to judgment as a matter of law.

Judge Valerie Baker, of the Los Angeles Superior Court, West District in Santa Monica, ruled on January 5 that there are disputed issues of material fact in the case and that the case against Bayside will proceed to a jury trial. That trial is presently set for March 20, but attorneys close to the case indicated that it may be delayed by further pretrial proceedings.
